Yesterday I was driving down the freeway on the carpool lane, there was an accident about 200 yd. in from t me so I gradually stopped. As I was stopping I saw the car behind me coming fast! So I knew I was gonna get hit, he slammed his breaks at the last minute and just totaled my moms brand new car. We made a report with the CHP, we both ha valid DL and insurance. So my mom calls her insurance and they are not covering the damages because she was conducting the automobile. Is this true in any accident? What insurance will have to pay? The car is brand new will they get her a new one? And I;m feeling a little pain today shod I get it checked? (I don;t have health insurance, I;m a college student). The automobile is totaled should she get a rental? And what exactly is GAP insurance she says she has that as well.Sorry for all the questions this is obviously my first accident anything would help and it;s deeply appreciated.

He hit you, so it;s his insurance his ticket for unsafe driving/following too closely. Once the cops give him the ticket, it;s pretty well done except for the paperwork. Weather the car is replaced or repaired is up to the insurance company, but remember that you do NOT have to take what they give you. They will make your Mom an offer, then it;s her decision weather or not to take it.
It all depends on the insurance policy. Some policies cover "permissive use" by someone other than the insured, others do not – and the assumption then is that the person using the car has insurance of their own. Many insurance companies will require the owner of the vehicle to have any licensed drivers living in the household either covered on the policy, or to show proof that they are covered elsewhere. This is because it is assumed that if you;re living in the house, you have access to the vehicle and could conceivably drive it.Are YOU (the driver) insured? On the plus side, if the guy behind you was totally at-fault, HIS liability insurance will pay the actual cash value of your mom;s car, and for a rental until the settlement is issued. Liability insurance pays for damages (injury or damaged property) that someone is liable for because the damage was their fault.Gap insurance covers the difference between the actual cash value of a vehicle (which is what you get in a total loss settlement) and the cost of buying a similar car. It;s often purchased for a period of time when you have a brand new car, because the value of the car drops the minute you drive it off the lot, because it can;t be considered "new" any more.
Please explain what you mean by saying: "she (Mom) was conducting the automibile".I do not understand the term conducting?
